A Raizen Energia foi absolvida do pagamento de adicional de periculosidade a um operador de trator que permanecia na máquina durante o abastecimento do veículo.

REPÓRTER - O empregado contou que trabalhava na zona rural de São Paulo e realizava diversos processos relativos ao preparo do solo para o plantio. O Tribunal Regional do Trabalho da 15ª Região, em Campinas, manteve a sentença que condenou a Raízen Energia ao pagamento do adicional de periculosidade ao tratorista.
Segundo o perito oficial, o veículo era abastecido por um caminhão comboio, uma vez por dia, por aproximadamente 15 minutos.
O TRT ressaltou que o profissional permanecia no veículo durante o abastecimento e, por isso, ficava exposto a situação de risco.
A empresa recorreu ao Tribunal Superior do Trabalho e argumentou que a exposição do empregado ao risco acentuado era eventual, e não intermitente.
A relatora do caso na Segunda Turma, ministra Maria Helena Mallmann, destacou que, para o TST, somente acompanhar o abastecimento do veículo não gera direito ao adicional de periculosidade.
A ministra mencionou o Quadro 3 do Anexo 2 da Norma Regulamentadora 16 do extinto Ministério do Trabalho. O dispositivo lista as atividades e operações perigosas com inflamáveis e quais empregados devem receber o adicional. A relatora explicou que o texto não contempla o empregado que acompanha o abastecimento do veículo por terceiro, como no caso do tratorista.
Dessa forma, por unanimidade, a Turma concluiu que a Raízen Energia não deve pagar o adicional de periculosidade ao operador de trator.
